These Terms of Service (“Terms”) govern your access to and use of the Samba Rentals website and owner portal at sambarentals.com (the “Service”), operated by Samba Rentals (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Samba Rentals provides a software platform that lets villa owners and property managers list their properties so they can be marketed to a network of rental booking agents, and view analytics about how those listings are viewed and shared. The Service is a software subscription; we are not a party to any rental agreement, booking, or transaction between you and any guest or agent.
You sign in using your Google account. You are responsible for maintaining the security of the account you use to access the Service and for all activity that occurs under it. You must provide accurate information and promptly update it if it changes. You must be at least 18 years old and able to enter into a binding contract.
You agree not to use the Service to publish false, fraudulent, or unlawful listings; to infringe others’ rights; to upload malicious code; to attempt to gain unauthorised access to the Service or other accounts; or to interfere with the Service’s operation.
The Service, including its software, design, and branding, is owned by us and protected by applicable laws. These Terms do not grant you any right to our trademarks or other intellectual property except as needed to use the Service.
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted or error-free, or that listing your property will result in any bookings, enquiries, or revenue.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the amount you paid us in the three months before the event giving rise to the claim.
You may stop using the Service at any time by cancelling your subscriptions and deleting your properties. We may suspend or terminate your access if you breach these Terms or to comply with the law. On termination, your listings will be unpublished.
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict of law principles. Disputes will be subject to the courts located in Indonesia, unless otherwise required by applicable consumer law.
